Overview

David Kaufman’s practice focuses on wireless telecommunications law, with particular emphasis in the field of radio – including wireless telephony, fixed operations (point-to-point and point-to-multi-point), private radio/public safety operations, wireless broadband (including both broadband radio service and educational broadband service), as well as traditional broadcast services. Mr. Kaufman has broad experience in administrative litigation in matters involving the FCC and other administrative agencies. In addition, he has served as both lead transactional counsel or communications counsel in telecommunications mergers and acquisitions. He also has experience in assisting communications companies seeking to raise debt or equity to fund their businesses.


Specific Experience

  • Participated in most major wireless telephony administrative hearing cases before the FCC over the past twenty-five years, as well as non-hearing cases involving mutually-exclusive applications.

  • Argued before the U.S. Court of Appeals on behalf of a wireless company involving a dispute over interpretation of FCC rules governing certain wireless service rules.
  • Drafted brief before the U.S. Supreme Court in a major case involving federal pre-emption of state zoning laws pertaining to communications towers.
  • Represented independent 800 MHz licensees during the 800 MHz rebanding rule making.
  • Testified before the FCC and in federal court as an expert appraiser of wireless properties.

Education

David Kaufman was an Edmund J. James Scholar at the University of Illinois, from which he graduated in 1973 with a B.A. in History, after three years, with high honors. He graduated from Georgetown University Law Center in 1976.

Admitted to practice in the District of Columbia.

Admitted to practice before the United States Supreme Court, and the United States Court of Appeals for the District of Columbia Circuit.

Member, Federal Communications Bar Association.
